11. Regardless of the basis of liability and cause, including damage caused by a defect to a product that forms part of the construction works (product liability) or damage resulting from defects in the works (consequential damage), ELCON shall not be liable for operating losses, loss of profit or other indirect losses. 12. ELCON shall be able to work unhindered and continuously within normal working hours according to a mutually agreed detailed schedule. 13. For winter measures during the winter months (1 November- 31 March), cf. ‘Regulations on construction work in the period 1 November to 31 March’, the following shall apply: ‘Seasonal winter measures’, cf. ‘Regulations on construction work in the period 1 November to 31 March’, are contained in the tender price. ‘Weather - related winter measures’, cf. ‘Regulations on construction work in the period 1 November to 31 March’, shall constitute additional work. If these are described in a winter tender list stating unit prices, these shall be applied according to Section 14, sub-section 3 of AB 92 and otherwise as services on a time and materials basis. If the Client refuses to pay, ELCON shall be entitled to an extension. ELCON shall further be entitled to payment of downtime costs for works under ‘Regulations on construction work in the period 1 November to 31 March’ and all construction and bridge works etc. 14. ELCON’s Terms and Conditions of Sale and Delivery form an integral part of the quote and therefore cannot be set aside by the tender documentation. 15. Tekniq’s Standard Conditions of January 2007 for electrical and plumbing works shall apply to the tender.
